Copyright and DMCA

PalSingles respects intellectual property and expects its users to. We respond to properly made infringement notices under the Digital Millennium Copyright Act.

About the cards themselves

The Palworld OFFICIAL CARD GAME is © Bushiroad. Palworld is © Pocketpair, Inc. PalSingles is an independent marketplace for secondary-market single cards and is not affiliated with, endorsed by, or sponsored by Bushiroad or Pocketpair.

Card names, collector numbers, set names and rules text appear on this site for product identification — so a buyer can tell which card they are buying. That is nominative use, and it is why a marketplace can name the products it sells.

Photographs of individual cards are taken and owned by the sellers who listed them.

Reporting infringement

If you own a copyright, or are authorised to act for the owner, and believe material on PalSingles infringes it, send a notice containing all of the following:

  1. A physical or electronic signature of the copyright owner or someone authorised to act for them.
  2. Identification of the copyrighted work you say has been infringed.
  3. Identification of the material you say is infringing, with enough detail for us to find it — a URL, a listing id, a store name.
  4. Your address, telephone number and email address.
  5. A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act on the owner's behalf.

Send it to our designated agent at orders@burnetttechsolutions.com with DMCA notice in the subject line.

A notice missing any of the six elements above is not effective and we may not be able to act on it. This is not us being difficult — the statute sets the requirements.

What happens next

  • We remove or disable access to the material, usually within two business days.
  • We tell the user whose material it was, and give them a copy of the notice.
  • We tell them they may submit a counter-notice.

Counter-notices

If your material was removed and you believe that was a mistake or a misidentification, you may send a counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material and where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief it was removed as a result of mistake or misidentification.
  4. Your name, address and telephone number.
  5. A statement that you consent to the jurisdiction of the Federal District Court for the district where you live (or, if outside the United States, any district in which we may be found), and that you will accept service of process from the person who sent the original notice.

If we receive a valid counter-notice we forward it to the original complainant. Unless they tell us within 10 business days that they have filed an action seeking a court order, we may restore the material.

Misrepresentation

Section 512(f) of the DMCA makes anyone who knowingly materially misrepresents that material is infringing — or that it was removed by mistake — liable for damages. Notices sent to remove a competitor's legitimate listings fall squarely inside that, and we will cooperate with a user pursuing it.

Repeat infringers

In accordance with the DMCA, we terminate the accounts of users who are repeat infringers in appropriate circumstances.

Trade marks

Trade mark complaints — a store name that impersonates a brand, or a listing using a mark to imply an endorsement it does not have — should also go to the address above. Identify the mark, its registration where applicable, and the specific content at issue.

Naming a card, a set or a game to describe the product being sold is not trade mark infringement, and we will not remove listings on that basis.

Sellers: use your own photographs

Taking another seller's images is both a copyright infringement and a code of conduct violation, and it is trivially detectable when the same photograph appears under two store names. Photograph your own cards. It sells them better anyway.
